These Terms of Service ("Terms") govern your access to and use of the website located at lucariexpress.com (the "Site") and any related services, content, and communications offered by Lucari Express LLC ("Lucari Express," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms govern your use of the Site only. They do not govern any delivery services Lucari Express provides to its commercial partners or customers, which are subject to separate agreements.

You must be at least 18 years old (or the age of majority where you live, if higher) to use the Site, submit a form, or opt in to receive communications from us. By using the Site, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

The Site is provided for general informational purposes and to allow you to contact us, request information about our services, apply for a position, or sign up to receive communications from us. We may add, modify, or remove features of the Site at any time without notice.

All content on the Site, including text, graphics, logos, images, photographs, layout, design, and software (the "Content"), is owned by or licensed to Lucari Express and is protected by United States and international intellectual property laws. We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these Terms, including removing content, suspending or terminating access to the Site, and reporting violations to law enforcement.

If you submit any information, messages, or other content to us through the Site (a "Submission"), you grant Lucari Express a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, store, and process that Submission for the purpose of providing the Services, responding to you, and operating our business. You represent that you have all rights necessary to make the Submission and that it does not violate any law or third-party right.

If you opt in to receive text messages from us:

• You agree to receive recurring automated marketing and/or transactional text messages from Lucari Express at the phone number you provide.
• Message and data rates may apply. Message frequency varies.
• You can reply STOP at any time to opt out of further messages, or HELP for assistance.
• Consent to receive marketing messages is not a condition of any purchase or service.
• If you change or relinquish your mobile phone number, you agree to promptly notify us so we can update our records.
• Our handling of your text-message information is also described in our Privacy Policy.

The Site may contain links to third-party websites, services, or resources that are not owned or controlled by Lucari Express. We do not endorse, control, or take responsibility for any third-party content, products, or services. Your interactions with third parties are solely between you and the third party, and are subject to their terms and privacy practices.

The Site and all content are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Lucari Express disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any defects will be corrected. Any reliance you place on information provided on the Site is at your own risk.

To the maximum extent permitted by applicable law, Lucari Express and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, business opportunities, or goodwill, arising out of or in connection with your use of or inability to use the Site, whether based on warranty, contract, tort, or any other legal theory, and whether or not Lucari Express has been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total cumulative liability arising out of or relating to these Terms or your use of the Site exceed one hundred U.S. dollars ($100).

You agree to indemnify, defend, and hold harmless Lucari Express and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) any Submission you make; (c) your breach of these Terms; or (d) your violation of any law or the rights of a third party.

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, all provisions of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, limitations of liability, indemnification, and governing-law provisions.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. If we make material changes, we may also notify you by other means. Your continued use of the Site after the changes take effect constitutes acceptance of the updated Terms.

These Terms and any dispute or claim arising out of or related to them or your use of the Site shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict-of-laws principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Cuyahoga County, Ohio, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision will not be deemed a waiver of that provision. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Lucari Express regarding your use of the Site. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms at any time without notice.
